1. Introduction and Acceptance

Welcome to Smart Parking Permits. These Terms and Conditions ("Terms") govern your use of our parking permit registration services, including our website at https://www.smartparkingpermits.com and our parking registration application (collectively, the "Service").

Smart Parking Permits is operated from Melrose, IL.

 

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

 

2. Service Description

 

Smart Parking Permits provides a digital parking permit registration system for residential properties. Our Service allows users to:

  • Register vehicles for parking permits by scanning QR codes at participating properties

  • Enter vehicle information and select parking duration

  • Pay for permits through our secure payment processor

  • Receive digital confirmation of permit registration

 

The Service facilitates parking management for property owners and provides a convenient registration process for parking users.

 

User Types

  • Our Service accommodates three types of users:

  • Visitors: Individuals who register for temporary parking permits without creating an account. Visitors enter their email, building/unit information, vehicle details, and select their parking duration.

  • Guests: Individuals who register using a PIN provided by a resident. Guest permits may be free or paid, depending on the resident's configuration.

  • Residents: Individuals with full accounts who have an active lease at a participating property. Residents can manage their vehicles, generate PINs for guests, and maintain ongoing parking subscriptions.

3. User Responsibilities

​

By using our Service, you agree to:

  • Provide accurate and complete vehicle information, including license plate number, make, model, year, and color

  • Maintain a valid payment method for paid permits

  • Comply with all parking rules and regulations established by the property where you are parking

  • Keep any PINs you generate for guests confidential and only share them with authorized individuals

  • Not transfer your parking permit to another vehicle or individual

  • Not attempt to circumvent, disable, or interfere with the Service's security features

 

You acknowledge that providing false or inaccurate information may result in permit denial, permit revocation, or vehicle towing at your expense.

 

4. Parking Registration

Permit Issuance

When you complete a parking registration, you will receive a permit number as confirmation. This permit number serves as your proof of valid registration.

​

Permit Limitations

  • Parking permits are non-transferable and valid only for the registered vehicle

  • Property management reserves the right to deny or revoke permits at their discretion

  • Monthly registration limits may apply at certain properties

  • Permit availability is subject to property capacity and policies

 

Registration Sessions

Payment sessions have a designated timeout. If payment is not completed within this timeframe, your registration session will expire and you will need to start a new registration.

 

5. Payment Terms

Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. We do not store your credit card numbers or sensitive payment information on our servers.

​

Pricing

Parking fees include:

  • Base rate (set by the property)

  • Payment processing fee

 

Hourly and daily rates are determined by each property and displayed during registration.

​

Billing

  • Visitors and Guests: Pay at the time of registration for the selected duration.

  • Residents: May be enrolled in subscription billing for ongoing permit access. Subscription charges are processed automatically according to your billing cycle.

Subscription Management

Residents can manage their subscriptions, including viewing billing history and updating payment methods, through the billing portal accessible in their account.

​

6. Cancellation and Refunds

​

Abandoned Registrations

If you do not complete payment within the session timeout, your pending permit registration will be automatically cancelled.

 

Refund Requests

Refund requests are handled on a case-by-case basis. To request a refund, please contact us at support@smartparkingpermits.com with your permit number and the reason for your request.

​

Resident Subscription Cancellation

Resident accounts and associated subscriptions are automatically cancelled when the lease period ends. Subscriptions are terminated when a resident account is deleted from the system.

 

7. Towing and Enforcement

​

Enforcement

Participating properties are monitored by an authorized towing partner. Vehicles parked without a valid permit or in violation of property parking rules may be subject to towing.

​

Towing at User's Expense

If your vehicle is towed due to lack of a valid permit or parking violations, you are responsible for all towing and storage fees. Smart Parking Permits is not responsible for these costs.

​

Data Sharing for Enforcement

Vehicle and permit information, including license plate numbers, permit status, and registration details, is shared with our authorized towing partner solely for the purpose of parking enforcement.

​

Disputes

Towing decisions are made according to property rules and regulations. For disputes regarding towing, please contact the property management or the towing company directly.

8. Limitation of Liability

​

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART PARKING PERMITS SHALL NOT BE LIABLE FOR:

  • Any damage to, theft of, or loss of your vehicle or its contents while parked at any property

  • Any indirect, incidental, special, consequential, or punitive damages

  • Any loss of profits, data, or goodwill

  • Any damages resulting from unauthorized access to or use of your account

  • Any errors or omissions in permit data or enforcement decisions

 

Parking at Your Own Risk

You acknowledge that parking is at your own risk. Smart Parking Permits does not guarantee the security, safety, or availability of parking spaces at any property.

Aggregate Liability Cap

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR PERMITS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Account Termination

​

Resident Account Expiration

Resident accounts are automatically scheduled for deletion 10 or more days after the registered move-out date. Any active subscriptions are cancelled upon account deletion.

Early Deletion Request

You may request early deletion of your account and associated data by contacting us at support@smartparkingpermits.com.

 

Termination by Smart Parking Permits

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms.

10. Intellectual Property

​

Ownership

Smart Parking Permits and its licensors retain all right, title, and interest in and to the Service, including all related intellectual property rights. The Smart Parking Permits name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Smart Parking Permits or its affiliates.

​

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.

​

User Content

You retain ownership of any vehicle information or other content you provide through the Service. By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content for the purpose of providing the Service.

 

11. Amendments

​

We reserve the right to modify these Terms at any time. Changes will be effective when posted to our website unless otherwise specified.

For material changes, we will make reasonable efforts to notify you via the email address associated with your account.

Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please discontinue use of the Service.

12. Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

​

Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Cook County, Illinois. You consent to the personal jurisdiction of such courts.

Dispute Resolution

Before initiating any legal action, you agree to first contact us at support@smartparkingpermits.com to attempt to resolve the dispute informally.

13. General Provisions

​

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

 

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Parking Permits regarding the Service.

 

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
